Wisconsin has some pretty tough marijuana laws despite the fact that they have one of the most active marijuana activist communities in the country. I would imagine things will change sooner than later with so many hardworking marijuana activists on the ground there. In the meantime, here are the current marijuana laws in Wisconsin, courtesy of Wisconsin NORML:

Decriminalized? — No.

Possession of any amount (first offense) is a misdemeanor, punishable by 6 months in jail and a $1,000 fine. Conditional discharge is available.

Possession of any amount (second or subsequent offense) is a felony, punishable by 3.5 years in prison and a $10,000 fine.

The distribution, cultivation, or possession with intent to distribute of less than 200 grams/1-4 plants is a felony, punishable by 3.5 years in prison and a $10,000 fine.

The distribution, cultivation, or possession with intent to distribute of 200-1,000 grams/5-20 plants is a felony, punishable by 6 years in prison and a $10,000 fine.

The distribution, cultivation, or possession with intent to distribute of 1,000-2,500 grams/21-50 plants is a felony, punishable by 10 years in prison and a $25,000 fine.

The distribution, cultivation, or possession with intent to distribute of 2,500-10,000 grams/51-200 plants is a felony, punishable by 12.5 years in prison and a $25,000 fine.

The distribution, cultivation, or possession with intent to distribute of 10,000 grams or more/200 plants or more is a felony, punishable by 15 years in prison and a $25,000 fine.

Distributing any amount to a minor that is at least 3 years younger than the offender can result in a possible 5 year jail sentence, in addition to the other related penalties.

Distributing any amount within 1,000 feet of a school, school bus, public park, public pool, youth center, community center, treatment facility, jail, or public housing can result in a possible 5 year jail sentence, in addition to the other related penalties.

Distribution on public transit can result in a possible 5 year jail sentence, in addition to the other related penalties.

***Note, 100 or more plants also brings federal charges***

Possession of paraphernalia is a misdemeanor, punishable by 30 days in jail and a $500 fine.

Distributing paraphernalia is a misdemeanor, punishable by 90 days in jail and a $1,000 fine.

Distributing paraphernalia to a minor is a misdemeanor, punishable by 9 months in jail and a $10,000 fine.

Subsequent paraphernalia offenses result in double the penalties.

Any marijuana conviction results in suspension of driving privileges for 6 months to 5 years (up to the judge).

Medical Program? — No.
