Eric Hafner is a former resident of Fair Haven, New Jersey, and has been living in North Hollywood, California since late January. Eric Hafner suffers from post-traumatic stress disorder (PTSD) and is a medical marijuana patient. Mr. Hafner’s doctor in California recommended that he use marijuana to help alleviate symptoms of his condition.

Eric Hafner originally tried to get approved to use medical marijuana in New Jersey, but PTSD is not listed as one of the eight qualifying conditions approved for medical marijuana use by the New Jersey Department of Health and Senior Services. The administrative rules that govern the New Jersey medical marijuana program dictate that two years have to go by before anyone can petition to add more conditions to the list.

Eric Hafner is currently facing criminal drug charges in New Jersey. The charges originated from a “November traffic stop when the car in which he was a passenger was pulled over on Locust Avenue because a headlight was out. A township police officer detected the smell of marijuana from inside the vehicle and found Hafner in possession of marijuana and a pipe commonly used to smoke the drug, police said.” Eric Hafner was scheduled for court earlier this month, but the court date was postponed until March 27 so that the prosecutor could study medical marijuana for the case.

“New Jersey is screwing up. This isn’t me doing anything wrong,” Hafner said before heading into the courtroom. “I don’t blame the police for this. If you’re a police officer, your job is to enforce the law. But in this case the law is flawed and we need to fix it,” Hafner said. “This is not going to be in the legal realm forever.”
