Ohio happens to have some pretty progressive marijuana laws when compared to it’s Midwest counterparts. The penalty for personal possession is the most liberal in the entire united states. California has the same fine, but not nearly the same limit. With Ohio native Peter Lewis funding marijuana reform, medical marijuana could be possibly coming to Ohio soon as well. Below are the current marijuana laws in Ohio, courtesy of Ohio NORML:

Decriminalized? — Yes. Possession of less than 100 grams is a civil citation, punishable by a $100 fine, not criminal charges.

Possession of 100-200 grams is a misdemeanor, punishable by 6 months to 1 year in jail and a $250 fine.

Possession of 200-1,000 grams is a 5th degree felony, punishable by 6 months to 1 year in jail and/or a fine of $2,500.

Possession of 1,000-5,000 grams is a 3rd degree felony, punishable by 1-5 years in prison and/or a fine of $10,000.

Possession of 5,000-20,000 grams is a 3rd degree felony, punishable by 1-5 years in prison and/or a $10,000 fine. Prison time is mandatory in this category.

Possession of 20,000 grams or more is a 2nd degree felony, punishable by 2-8 years in prison and/or a $15,000 fine. Prison time is mandatory in this category.

Cultivation of less than 100 grams is a not a criminal offense, and carries a fine of $100.

Cultivation of 100-200 grams is a 4th degree misdemeanor, punishable by 30 days in jail and/or a $250-500 fine. If the cultivation was near a school, it is a 3rd degree misdemeanor.

Cultivation of 200-1,000 grams is a 5th degree felony, punishable by 6 months to 1 year in jail, and a $2,500-5000 fine. If it was near a school, it is a 4th degree felony.

Cultivation of 1,000-20,000 grams is a 3rd degree felony, punishable by 1-5 years in prison, and a $10,000-15,000 fine. If it was near a school, it is a 2nd degree felony.

Cultivation of 20,000 grams or more is a 2nd degree felony, punishable by 2-8 years in prison, mandatory sentence, and a $15,000 fine.

Any possession of less than 5,000 grams may be probation only; it’s up to the judge.

Distribution of 20grams or less for no compensation is not a crime, and carries only a $100 fine.

Distribution of less than 200 grams is a felony, punishable by 6-18 months in jail and a fine to be determined by the judge.

Distribution of 200-600 grams is a felony, punishable by 1-5 years in prison and a fine to be determined by the judge.

Distribution of 600 grams or more is a felony, punishable by a 6 month mandatory prison sentence but could range up to 8 years depending on the amount. A fine is to be determined by the judge.

Distributing any amount within 1,000 feet of a school, or 100 feet of a juvenile, and a prior drug felony, will result in a felony charge. The current felony is punishable by jail time and fines that are to be determined by the judge, in addition to related penalties.

Possession of paraphernalia is a misdemeanor, punishable by 30 days in jail and a $750 fine.

Distributing paraphernalia is a misdemeanor, punishable by 90 days in jail and a $1,000 fine.

Criminal marijuana convictions result in suspension of driving privileges for 6 months to 5 years, depending on the offender’s criminal record. Citations do not count.

This state allows conditional release for first time prosecutions. After probation and treatment, charges are dropped from the offender’s record.

Medical Program? — No.
